  1. ABOUT THESE TERMS

These Terms of Service govern your use of alejandrobarzaga.com and purchases from Barzaga, LLC, operating under the brand BÁRZAGA (“we,” “us,” or “our”).

By using our website or placing an order, you agree to these Terms and the policies referenced below. Nothing in these Terms limits consumer rights that cannot be excluded under applicable law.

Our store is hosted by Shopify, which provides the ecommerce platform we use to offer our products and process orders.

  1. USE OF OUR WEBSITE

To place an order, you must have the legal capacity to enter into a binding agreement and be authorized to use the payment method provided.

You agree to provide accurate contact, billing, and delivery information and to keep any customer account credentials secure.

You must not use our website for unlawful purposes, submit fraudulent orders, introduce malicious code, interfere with website security, or infringe the rights of others.

We may restrict access when reasonably necessary to address fraud, security threats, or misuse. This does not remove our obligations concerning existing purchases.

  1. PRODUCTS AND PRESENTATION

BÁRZAGA offers clothing, silk scarves, and other objects, which may include limited editions, made-to-order pieces, and personalized commissions.

Please review each product’s description, measurements, materials, care instructions, availability, and production timeframe before purchasing.

We aim to represent our products accurately. Colors may appear differently depending on your screen. Minor variations associated with handcrafted production or natural materials may occur, but products must conform to their descriptions and applicable legal requirements.

  1. PRICES AND PAYMENT

The applicable currency and order total are displayed at checkout. Shipping charges, taxes, and duties collected at checkout will be shown before payment.

Prices may change for future purchases. A later price change does not alter the agreed price of an accepted order.

If we discover a material pricing or product information error affecting your order, we will contact you to resolve it. We will not charge an additional amount without your agreement. If the order cannot proceed, any payment collected for the canceled items will be refunded promptly.

  1. ORDERS AND AVAILABILITY

Orders are subject to availability and payment verification. An automated order acknowledgment confirms that we have received your order.

If we cannot fulfill an order because of unavailable stock, suspected fraud, or another legitimate reason, we will notify you and promptly refund any payment collected for the canceled items.

Please contact info@alejandrobarzaga.com as soon as possible if you need to correct or change an order. Changes may not be possible once production or dispatch has begun, subject to your applicable legal rights.

  1. MADE-TO-ORDER AND PERSONALIZED PIECES

Production timelines and any required measurements, fittings, or design approvals will be communicated in the product description or agreed with you before production begins.

Please provide accurate measurements and review the specifications we send for approval. Requests to change approved specifications may affect the price or completion date. Any additional charges require your agreement.

Items made to your individual specifications or clearly personalized may be excluded from change-of-mind returns as described in our Returns & Refunds policy. Being made to order does not, by itself, make every item non-returnable.

Your rights concerning defective, damaged, or incorrectly supplied items remain unaffected.

  1. SHIPPING AND DELIVERY

Standard shipping within the United States is included in the product price. International shipping is charged separately and displayed at checkout.

Preparation or production time is separate from carrier transit time. Any applicable import charges not collected at checkout may be payable upon import, as explained in our Shipping Policy.

If we cannot ship within the promised timeframe, we will notify you, provide an updated estimate, and offer the opportunity to agree to the delay or cancel the affected unshipped items for a prompt refund, as required by applicable law.

If a shipment is delayed, appears lost, or arrives damaged, contact us so we can investigate and help resolve the issue.

  1. RETURNS AND REFUNDS

Eligible, non-personalized items may be returned subject to that policy, with requests made within 14 days of delivery.

We do not charge a restocking fee. Customers are responsible for return shipping for change-of-mind returns. If an item is defective, arrives damaged, or was incorrectly supplied by us, we cover the necessary return shipping costs.

Nothing in these Terms or our policies limits mandatory cancellation, return, refund, or other consumer rights.

  1. INTELLECTUAL PROPERTY

Website content, including original photography, text, artwork, graphics, and branding, belongs to Barzaga, LLC or its respective licensors and is protected to the extent provided by applicable intellectual property law.

Purchasing a product does not transfer intellectual property rights in the product or associated content.

You may use the website for personal shopping and informational purposes. Commercial reproduction or exploitation of protected content requires permission from the relevant rights holder, except where otherwise permitted by law.

  1. REVIEWS AND CUSTOMER CONTENT

If you submit a review or other content for public display on our website, you give us a non-exclusive permission to display that content for its intended purpose.

You must have the necessary rights to submit the content. It must not be unlawful, misleading, abusive, or infringe another person’s rights.

Private correspondence, measurements, and order information are handled according to our Privacy Policy. Sending us a private message does not authorize us to publish it as a testimonial.

We remain responsible for fulfilling our contractual obligations and meeting applicable legal requirements concerning our products and services.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any liability or consumer remedy that cannot lawfully be excluded or limited.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Florida and applicable United States federal law.

If mandatory consumer protections in your place of residence apply to your purchase, those protections remain available. These Terms do not restrict any right you have under applicable law to bring a claim in your local courts.

  1. CHANGES AND SEVERABILITY

We may update these Terms and will publish the revised version with an updated date. Changes will apply prospectively and will not retroactively remove rights associated with an existing purchase.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
